The National Assembly Adopted the Law on Electronic Document and Electronic Signature
 
The Law on Electronic Document and Electronic Signature, elaborated by the CSD Task Force with the assistance of an Expert Advisory Board (the stakeholders representatives as the Bulgarian National Bank, the Central Depository, the Bulgarian Stock Exchange, the Ministry of Justice, Ministry of Economy, the Council of Ministers, State Telecommunications Commission, Bulgarian Industrial Association, BORICA AD, lawyers and IT experts) was passed on second reading by Parliament last Friday, March 22, 2001 and was promulgated in State Gazette No 34/06.04.2001.

In April 2000 CSD published the initial research outcome on foreign legislation and the Law's draft version in a collection titled Electronic Commerce and Electronic Signature - Legal Aspects, while its latest version, approved by the Bulgarian Government on September 28, 2000, took into consideration most of the opinions, suggestions and recommendations made by the stakeholders, Bulgarian and foreign experts.

The Draft and the newly passed Law are based on the main principles of the Directive 1999/93/EC on a Community framework for electronic signatures that came into force on 20 January 2000 and on a number of international acts and successfully implemented national provisions in other countries.

The Law, which is to come into force in six months' period after promulgated in the State Gazette, will recognize the legal validity of electronic signatures. It will also regulate procedures on certification services delivery, the obligations of their providers, and will specify the terms on advanced and universal electronic signature. The reliability and security of the latter will be under the control of the State Telecommunications Commission. Meanwhile the Cabinet is adopt secondary legislation elaborated and proposed by the State Telecommunications Commission.

The new Law on Electronic Document and Electronic Signature will be included in a second edition of the collection Electronic Document and Electronic Signature - Legal Aspects which is in process of preparation. The edition will also include comments on the Law as well as newly adopted foreign and international legislation.
