Workshop: Reforming Judiciary in Bulgaria: Towards the Introduction of Modern Registration System
 
On September 20, 2002, the Center for the Study of Democracy organized a workshop Reforming Judiciary in Bulgaria: Towards the Introduction of Modern Registration System. The event was attended by representatives of the judiciary and the executive, non-governmental organizations, the business community and media.

In her opening address Dr. Maria Yordanova, Director of CSD Law Program, briefed the participants on the activities of the CSD in the field of judicial reform in Bulgaria and outlined the necessity of modernizing the registration system in the country and the anti-corruption impact this process could have.

The Norwegian experience with the development and operation of centralized electronic registers was presented by Mr. Ulf Ertzaas, Senior Legal Advisor at Norway Registers Development (NRD), and Mr. Erik Fossum, Director General of the Bronnoysund Register Centre (BRC). Mr. Ertzaas presented the activities of NRD in the field of development, implementation and operation of electronic registers and made a short overview of the legal basis for registers of legal entities in Norway. Mr. Fossum made a presentation of the BRC - a centralized register authority in Norway - and described the different registers kept by the BRC and the registration procedures applied thereof.

Mr. Borislav Belazelkov, Justice, Supreme Court of Cassation, presented the report Opportunities for Development of Central Register of Legal Entities and Electronic Register Center in Bulgaria, developed by a CSD Task Force including distinguished lawyers and IT experts. The report is a result of a comparative research and analysis of the foreign and international experience in the area of modern registration systems and procedures and is aimed to serve as a basis for the development of overall concept on registration reform in Bulgaria. The proposed reforms are aimed at transforming judicial registration procedures into administrative ones by replacing the court registration with registration into a centralized electronic register.

The full text of the report, presentation of the experience of Norway and other European countries as well as of the operation of the European Business Register are included in a brochure Reforming Judiciary in Bulgaria: Towards the Introduction of Modern Registration System. The brochure was developed by the CSD and was distributed among the participants at the workshop.

The Director of the Central Pledges Register in Bulgaria Ms. Elena Petkova expressed her support to the efforts for reforming registration in Bulgaria, pointing out the successful experience of the Central Pledges Register - the only centralized electronic register in Bulgaria, created in 1997. Mr. Tsvetan Simeonov, Vice President of the Bulgarian Chamber of Commerce and Industry, presented the operation of the electronic register of commercial legal entities, kept by the Bulgarian Chamber of Commerce and Industry. In the course of the discussion the other participants also supported the idea of introducing modern approach as regards to official registration in Bulgaria.

The workshop was part of the project Reforming Judiciary in Bulgaria: Towards the Introduction of Modern Registration System, implemented by CSD with the support of the Norwegian Ministry of Foreign Affairs under the Plan of Action for the Candidate Countries to the EU.
